# Strategy Guide — Scenario 75: "Two Experts, One Child"

*Game documentation for a fictional simulation in "The First 90 Days" (Tactic Watch). The family, the case, and every choice below are fictional. This guide is general information about how the scenario is built — it is not legal advice for any real case.*

## (1) The win

**Best ending: "The Evaluator Is Not the Judge."**

State it honestly: this is a stepped return, not an instant reunification. The court credits the treating therapist and the visit record over the evaluation's conclusion, enters findings under § 6351(f)(3) for Vernon, and orders expanded unsupervised visits now, overnights on a schedule, and return home by the next review if the steps hold. Paloma does not come home the day of the hearing. What Vernon wins is the thing the hearing was actually capable of giving: the court weighed the expert's opinion as evidence — with a visible method, contradicted in part by her own notes — instead of receiving it as a verdict.

The middle ending, **"Two Reports, One More Question,"** is a **partial** win: no return yet, but the evaluation's recommendation is not adopted either; the court orders a focused re-evaluation limited to the post-treatment bond and expands visits meanwhile.

## (2) The route

Verified by walking the scenario graph from the start node (see the verification note at the end). Key decision points, in order — node title, winning choice, and what it changes:

1. **Ask for the Whole File** — *Send the written request today — full agency record plus the complete evaluation file, named item by item.* Cash −20. Sets **recordsRequested**. The agency record "shall be released upon request" (55 Pa. Code § 3130.44(d)); without this envelope there are no notes to cross-examine with, and the win ending closes at the source.
2. **Build the Cross Before You Need It** — *Build the method memo — every question tied to a page.* Cash −15. Sets **crossReady**. Note what the memo does not do: it never attacks Dr. Marsh's credentials. She is qualified. It attacks the only soft thing in the evaluation — its method.
3. **Day Nine: What the Envelope Holds** — *Open the evaluation file and read Dr. Marsh's own session notes, line by line.* Flag-gated on **recordsRequested**. Hidden item: *"File — evaluation raw notes released on written request (§ 3130.44(d)): 'sought father's lap repeatedly'."* The evaluator's observations are in tension with her conclusion's adjective, and that tension is now admissible ammunition.
4. **A Witness or a Letter** — *Ask today — counsel confirms Ms. Ferro's live appearance and subpoenas her session records.* Cash −35. Sets **therapistLive**. She agrees only because she was asked by day 9; asked later, she simply is not there. Together with **crossReady**, this is one of the two named gates on the win.
5. **Thirty Visits, in a Logbook** — *File the written summary of the supervisor's logs through counsel, as an exhibit for the review.* Cash −10. Sets **visitRecordFiled**; hidden item: *"Exhibit — visit supervisor logs: 30 visits, child's approach behavior documented."* The longest continuous record of the bond, kept by a neutral witness, offered instead of left in the file.
6. **Answer It in Writing** — *File the written rebuttal — the imported adjective answered, with the notes and logs attached.* Cash −10. Sets **summaryRebutted**; hidden item: *"Rebuttal — scored summary's imported adjective answered in writing (Rule 1340(E)/(F) — untested)."* The scored summary had copied "attenuated" in as a data line; the rebuttal makes the word fight for its place before findings are drafted from the packet.
7. **Ask in Findings Language** — *Go in with the drafted ask — findings, stepped return, and the focused-question fallback.* Sets **steppedAsk**. If the court credits your witnesses, the order it needs is already written in the grammar of § 6351(f)(3) and (f.1); the fallback (a focused question, not a repeat of the same instrument) is what the partial ending is later built from.
8. **Your Cross-Examination** — *Cross on the method — ninety minutes, no comparison, stale records, her own words read back.* Flag-gated on **crossReady** + **recordsRequested**; sets **methodCrossDone**; hidden item: *"Transcript — cross-examination: 90 minutes observed; no comparison observation; records pre-dated treatment."* Dr. Marsh does not recant — experts never do. She reads her own lap line aloud, and the judge writes something down.
9. **The Other Witnesses** — *Call Ms. Ferro — live, sworn, with fourteen months of session records in her hands.* Flag-gated on **therapistLive**; hidden item: *"Transcript — treating therapist testified live: fourteen months of sessions."* Ninety minutes is a photograph; fourteen months is a film; the court weighs both for exactly what they are.
10. **The Judge Asks About the DUI Year** — *Answer it straight.* Sets **answeredStraight**. No evasion, no weather metaphors: the drinking, the arrest, and the dated machinery of the eight months since. Some testimony is weighed; some is believed; the difference is audible.
11. **Closing: What the Record Can Carry** — *Argue the whole record and hand up the drafted ask: stepped return under § 6351(f)(3) and (f.1).* Flag-gated on **therapistLive** + **crossReady** + **recordsRequested** + **visitRecordFiled** + **summaryRebutted** + **methodCrossDone**; hidden item: *"Order — findings credit the treating witnesses; stepped return ordered."* It leads to **The Evaluator Is Not the Judge**. You finish the route with **$110 of the $200** starting cash remaining.

## (3) Why this wins — the law as it is supposed to work

Only principles from the scenario's verified set are stated here:

- **The permanency determinations belong to the court, on all the evidence.** At each permanency hearing the court must determine the continuing necessity of placement, compliance with the permanency plan, progress toward alleviating the circumstances that caused placement, and whether reasonable efforts were made to finalize the plan (42 Pa.C.S. § 6351(f)(1), (2), (3), (5.1)); its options include return to a parent (§ 6351(f.1)). No rule requires a formal bonding evaluation at all, and no rule makes an evaluator's conclusion binding — an expert opinion is an input with a method, and the people who see the child weekly are witnesses too. The route is built entirely on that framing: it does not out-argue the evaluation, it out-evidences it.
- **You cannot cross-examine a report you never obtained.** The agency record "shall be released upon request" (55 Pa. Code § 3130.44(d)), and the rule is not to be read to protect agency employees' privacy as a basis for withholding (§ 3130.44(f)). Steps 1 and 3 are that right, exercised in writing on day 0 and cashed in on day 9: the raw notes, the scoring sheets, and the stale-records list.
- **Reports are meant to be controverted, with their makers present to question.** The disposition statute states the principle plainly: parties may examine and controvert written reports and cross-examine the people who made them (42 Pa.C.S. § 6341(d)(2)). The scenario frames the permanency-review posture on that stated principle — it is the spine of both the method cross and the insistence on a live therapist over her letter.
- **The scored summary's borrowed adjective can be answered in writing — as an argument, honestly labeled.** Pa.R.J.C.P. 1340(E) allows evidence and argument to rebut a provision and 1340(F) allows factual errors to be challenged; whether Rule 1340 reaches a scored assessment summary has **not** been tested in a published opinion, and the scenario's rebuttal says so in its own footnote. Step 6 is that untested argument, made carefully, so "attenuated" does not enter the findings by reference and unopposed.
- **The clock that is not today's fight stays identified.** Paloma is at eight months in placement; the fifteen-of-twenty-two-months determination under § 6351(f)(9) belongs to a later hearing. Naming it on the eve of the review keeps the case's real deadlines from blurring into this one.

## (4) The traps

1. **The hallway request at "Ask for the Whole File"** — asking the caseworker informally instead of sending the written § 3130.44(d) request. Cost: no **recordsRequested**, no raw notes, ever. The method cross loses its bite (it is flag-gated on the request), the notes that contradicted the adjective stay in a file nobody opened, and the route runs to **"Forty-Five Minutes"** — the evaluation adopted nearly verbatim, its word used three times in the goal discussion.
2. **The letter instead of the witness at "A Witness or a Letter"** — relying on Ms. Ferro's two pages. Cost: no **therapistLive**, and the win ending is capped no matter how good the cross is. A letter cannot raise its hand when agency counsel misquotes it; judges notice who a side did not call. Best available outcome becomes the partial ending, **"Two Reports, One More Question."**
3. **The credential attack at "Your Cross-Examination"** — challenging whether Dr. Marsh is qualified at all. She is, gleamingly, and each question becomes an occasion for her to recite another qualification in front of a judge who has heard her before. The method — the ninety minutes, the missing comparison, the stale file — goes unpressed, credibility is spent on the witness's strongest ground, and the ceiling drops to the partial ending.
4. **Skipping the rebuttal at "Answer It in Writing"** to save $10 and an afternoon. Cost: no **summaryRebutted**; "attenuated" survives in the agency's own scored summary, unanswered, exactly where tired findings-drafting borrows its language. The win gate at closing requires the rebuttal; without it the route caps at the partial ending. The same cap applies to leaving the visit logs unfiled — a true pattern nobody offered is furniture in a room the judge walks through quickly.

## (5) What no strategy controls

The judge's weighing of two professionals. Whether she has heard Dr. Marsh before and trusts her, or has seen a hundred ninety-minute evaluations and discounts them all. Ms. Ferro's Wednesday calendar. The agency's choice of evaluator, the stale file she was handed, and the plain luck of what her session notes happened to say — in another case the notes might have supported the conclusion entirely, and the same envelope would have carried bad news just as faithfully. The route above controls only the distance between a file that exists and a file that was asked for: the request, the memo, the subpoena, the filing, the rebuttal, the drafted ask — each done in writing, in the room, on time. Outcomes in this system turn on workers, judges, and luck as much as on any parent; the strategy's whole claim is that when the weighing happened, there was something on both sides of the scale.

*Verification: this route was walked programmatically against `scenario-75.json` — each named choice was followed from the start node in order; every intermediate node and choice exists; every flag-gated choice's requirements were satisfied by flags set earlier on the walk; the walk terminates at the ending node titled "The Evaluator Is Not the Judge" after visiting 30 nodes, with $110 of the $200 starting cash remaining.*
