# Strategy Guide — Scenario 73: "The Agency's Burden"

*Game documentation for a fictional simulation in "The First 90 Days" (Tactic Watch). The family, the case, and every choice below are fictional. This guide is general information about how the scenario is built — it is not legal advice for any real case.*

## (1) The win

**Best ending: "Not Dependent — The Burden Was Not Carried."**

State it honestly: this one is a genuine win, and it is the only full win in the scenario. The court finds neither allegation proven by clear and convincing evidence, the petition is dismissed, and Esme comes home on Thursday, December 3, 2026 — day 31, the second day of trial. It is not a finding that Stefan was a perfect father; the order's findings list the allegations *not proven*, by name, which is a different and narrower thing, and the scenario is built to keep that distinction visible.

The other endings, labelled as they deserve: **"Dependent — But the Placement Ends"** is a **partial** win — Esme goes home the same day, but under a dependency adjudication and supervision (§ 6351(a)(1)), on one narrow appointment finding, with the abuse allegation expressly not among the findings. **"Dependent on the Summary"** is a **partial-loss** — a losing outcome (adjudicated, placement continues) with one salvage: everything that *was* preserved on the transcript remains usable at disposition and later. **"Adjudicated on Their Paper"** is a **loss** — adjudicated on all allegations, disposition on day 38 continuing placement with § 6351(b) findings read against him.

## (2) The route

Verified by walking the scenario graph from the start node (see the verification note at the end). Key decision points, in order — node title, winning choice, and what it changes:

1. **Shelter Care — Thursday** — *Have Mr. Beaumont name your sister on the record as a kin resource, willing to be assessed as a placement today.* Sets **kinshipOnRecord**. A sentence spoken in the room, kept by the transcript; the sister is a placement resource and the fall's eyewitness, and both roles start here.
2. **The Written Request** — *Send the written request for the complete agency record this week, and keep a dated copy.* Cash −20. Sets **recordsRequested**; hidden item: the complete agency record released on request (§ 3130.44(d)), including one ER photograph misfiled by date in the "pattern" exhibit set. This is Hinge A, and it is the highest-leverage move in the scenario: the photograph error exists whether or not anyone finds it in November, but it can only be cross-examined on in December if it was found.
3. **The Clinic's Own Paper** — *Ask the clinic for copies of the closure and reschedule letters, to be offered as an exhibit at trial.* Cash −10. Hidden item: the clinic closure and reschedule letters, admitted as an exhibit. The petition's neat row of three missed appointments now has to argue with the clinic's own dates.
4. **Calling Early, With Dates** — *Have counsel call Ms. Nakamura today — trial dates, subpoena information, and what she would be asked about.* Sets **treatingWitness**. This is Hinge B. The treating nurse practitioner agrees to testify *only* because the call came in November, with dates, while her December could still be rearranged. Together with **recordsRequested**, this flag is the gate on the win ending.
5. **Rehearsing Dates, Not Feelings** — *Rehearse with her the way counsel directs: date, time, the fall, who was present — dates, not feelings.* Sets **kinReady**. The sister's account of the fall becomes sworn, specific, identical-on-cross evidence instead of a heartfelt blur.
6. **Thanksgiving, With a Chair Empty** — *Eat with your family, bring the trial folder home unopened, and sleep at a human hour.* Cash −25 (groceries). No flag. The human beat is deliberate: the trial will only ever see what the waiting produced, and rest is part of producing it.
7. **Final Prep, at Counsel's Office** — *Pay for the final copies and the trial-day travel, and organise the folder exactly as counsel's outline orders it.* Cash −12. The folder that opens to the right page is a small, real advantage.
8. **The Hard Questions, Practised** — *Rehearse the hard questions until the answers are ninety seconds long: the letters, the admissions, nothing extra.* Sets **testifyReady**. Stefan admits the two genuinely missed appointments and produces the reschedule letters — rehearsed, narrow, and over in ninety seconds. This flag is what makes his later testimony a choice instead of a hazard (see **Your Name, or Silence** below).
9. **The Summary Is Offered** — *OBJECT, now, on the record: the scored summary should not be used as proof at adjudication without a witness who can be questioned about how it was scored.* Sets **preservedObjection**; hidden item: the transcript of the objection at the moment the summary was offered (Rule 1340 — untested). This is Hinge C, and it is a question of *seconds*: objected-to when offered, the summary is ruled not to be proof without a sponsoring witness, and the objection and ruling are preserved either way. (Supporting earlier choices: the bus to **One Hour, in a Room With a Clock**, cash −8, keeps the visit record clean; the plan made at **When, Exactly, to Object** is what makes the timing in this step a decision rather than an improvisation.)
10. **Mr. Petrov Testifies** — *Cross on the exhibit list: the photograph filed under a different date, in the agency's own record.* This choice is flag-gated: it is only available with **recordsRequested**. The caseworker concedes the clerical filing error candidly, the exhibit list is corrected on the record, and the "pattern" is left resting on one bruise and one documented fall.
11. **Dr. Marsh, by Photograph and File** — *Cross on the foundation: what she examined, what she was sent, and what her differential never contained.* Cash −6 (day-one parking and coffee, taken at **Cross: Never Examined the Child**). Hidden item: the transcript of the agency expert — never examined the child, had not seen the clinic closure letters, and had never been sent the sister's statement, so the playground fall is absent from her differential by her own admission. Trial courts weigh credibility, and an expert who examined the child and one who read a file are not the same witness; this cross makes the judge see the difference in the agency's own witness's words.
12. **Trial Day Two — the Defense Case** — *Call Ms. Nakamura — the treating nurse practitioner who has examined Esme since infancy.* This choice is flag-gated: it is only available with **treatingWitness**. Hidden item: her testimony — *"I have examined this child fourteen times"* — with the growth chart, the clinic's closure and reschedule history from her own chart, and a treating clinician's account of what a single playground-fall bruise looks like in this particular child.
13. **Your Name, or Silence** — *TESTIFY — rehearsed, narrow, with the clinic letters: ninety seconds of answers and nothing extra.* This choice is flag-gated: it is only available with **testifyReady**. (Resting instead is a principled choice in the fiction — the burden was never Stefan's — and it still reaches the closing; testifying unrehearsed does not, see the traps.)
14. **Closing — Element by Element** — *Close on the burden, element by element, and ask for findings naming each allegation that was NOT proven.* This choice is flag-gated: it is only available with **recordsRequested** + **treatingWitness** both set. Hidden item: the order whose findings list the allegations not proven, by name. It leads to **Not Dependent — The Burden Was Not Carried**.

You finish the route with $109 of the $190 starting cash remaining (bus fare −8, record copies −20, clinic copies −10, Thanksgiving groceries −25, final-prep copies and travel −12, trial-day parking and coffee −6). Notice what the money bought: paper, witnesses' logistics, and presence — never outcomes.

## (3) Why this wins — the law as it is supposed to work

Only principles from the scenario's verified set are stated here:

- **The burden is the agency's, and it is a high one.** At adjudication, the court may find a child dependent only "from clear and convincing evidence" — 42 Pa.C.S. § 6341(c). The parent does not have to prove innocence or fitness to win; the judge decides credibility; a fact not proven is a fact the court cannot use. The whole route is that discipline, operationalised: make the agency actually prove each allegation, and be ready — with paper and witnesses — at the exact places its proof can be answered. Where the burden is not carried, the petition is dismissed and the child discharged — § 6341(a).
- **The early hearings run on statutory clocks, with counsel.** A shelter care hearing within 72 hours of removal (42 Pa.C.S. § 6332; 23 Pa.C.S. § 6315(d)), with the right to counsel, appointed if the parent cannot afford one (§ 6337; counsel at shelter care, § 6332(a)). Those hearings decide placement for now; the trial decides the facts — and disposition, if there is one, follows immediately or within 20 days of adjudication when the child was removed (§ 6341(c)), which is why the placed branch's disposition lands on day 38.
- **Agency records are obtainable on request** — the record "shall be released upon request," 55 Pa. Code § 3130.44(d), and the rule is not to be read to protect agency employees' privacy as a basis for withholding (§ 3130.44(f)). Step 2 is that right, exercised in writing, in November — early enough for what it reveals to be cross-examined on in December.
- **A scored summary is not testimony — and the argument that polices it is flagged, every time, as untested.** The objection at step 9 rests on Pa.R.J.C.P. 1340(A) and (B)(1) (ask for the evidence under a score), (E) (present evidence and argument to rebut a provision), and (F) (factual errors may be challenged). Whether Rule 1340 reaches a scored assessment summary has **not** been tested in a published opinion; in the game as in the guide, it is an argument counsel makes on the record, not a settled right. Making it *when the summary is offered* is what puts the objection, the argument, and the ruling into the transcript — where anyone who was not in the room can ever find them.
- **Credibility is the trial's real currency, and it has mechanics.** Published Pennsylvania decisions include agency petitions denied at trial where the court credited the family's witnesses and experts over the agency's. The route builds exactly that contest in its strongest available form: a treating clinician who examined the child fourteen times against an expert who reviewed photographs and a file; an eyewitness rehearsed on dates against a differential that never contained the fall; an agency exhibit list corrected by the agency's own caseworker. None of that guarantees a credibility finding. It gives the judge something solid to base one on.

## (4) The traps

1. **The late witness call at "Calling Early, With Dates"** — waiting until the week of trial because "she knows Esme; of course she will come." Cost: no **treatingWitness**. Her December was filled in October; the defense's only live medical voice becomes a letter, which cannot be questioned and cannot answer the agency's expert in the room. The win choice at **Closing — Element by Element** is gated off, and the route caps at **Dependent — But the Placement Ends** at best.
2. **The lunch-hour objection at "The Summary Is Offered"** — holding the objection to raise it collegially with the agency's lawyer in the hallway, off the record. Cost: **preservedNothing**. The summary is admitted in the morning "like weather"; the hallway conversation preserves nothing, because the transcript only keeps what was said in the room. At closing, the only summary-specific lead argues from that hallway talk, and it produces **Dependent on the Summary** — the scored page anchors the finding, and placement continues toward a day-38-window disposition.
3. **Unrehearsed testimony at "Your Name, or Silence"** — testifying without **testifyReady**, determined to "finally explain everything." Cost: the whole trial. The volunteered neighbour-grudge theory is visibly discounted, the missed appointments blur from two into "a few," the reschedule dates come out in the wrong order — and Stefan's own sworn words supply the gaps the agency's case still had. That branch goes directly to **Adjudicated on Their Paper**: adjudicated on all allegations, disposition on day 38 continuing placement with § 6351(b) findings (contrary to the child's welfare; reasonable efforts) read on the record against him.
4. **No record request at "The Written Request"** — taking the caseworker's free two-page summary instead of the written request. Cost: no **recordsRequested**. The misfiled photograph is never found, the gated cross-examination of Mr. Petrov on the agency's own exhibit list never exists, the word "pattern" keeps the weight of a photograph of a different day that nobody outside the agency ever saw — and the win choice at **Closing — Element by Element** is gated off by design. The cap, again, is **Dependent — But the Placement Ends** at best. This is the scenario's quiet thesis: the cheapest move in it (a dated letter and $20 of copies) is the one two of its four endings turn on.

## (5) What no strategy controls

The judge's credibility calls — whether a treating clinician outweighs a file-review expert in *this* courtroom, on *this* day, is the judge's to make, and a different judge could weigh the same transcript the other way. Dr. Marsh's honesty about the limits of her materials, and Mr. Petrov's candour about the exhibit list, were the witnesses' own; a less candid cross-examination subject changes December without Stefan changing anything. The clinic's December schedule, the agency's filing care, the foster home Esme happened to land in, and the plain luck of which photograph a clerk filed wrong all sat outside the route entirely. The strategy's whole claim is narrower: the parts that *were* Stefan's — a written request in November, a witness called with dates, an objection spoken in the room at the offered moment, ninety seconds of rehearsed answers — were done on paper, on the record, and on time, so that when the uncontrollable happened, it happened to a record he had helped build. Outcomes in this system turn on workers, judges, and luck as much as on any parent's choices. This guide will never tell you otherwise.
