# Strategy Guide — Scenario 70: "A Report Is Not a Witness"

*Game documentation for a fictional simulation in "The First 90 Days" (Tactic Watch). The family, the case, and every choice below are fictional. This guide is general information about how the scenario is built — it is not legal advice for any real case.*

## (1) The win

**Best ending: "Dismissed — A Report Is Not a Witness."**

This one is a full win, and it is worth saying plainly what that means here: the petition is dismissed and Jade comes home the same evening. The overnight allegation — the petition's central claim — is found not proven, and the one remaining allegation, the missed school week, is explained by the nurse's own original note (a sick child, a father's phone call to the school), so nothing is left that can carry a dependency finding. The middle ending, **"Dependent on Less Than the Agency Asked,"** is a **partial** win: the overnight allegation is struck and Jade still comes home, but under court-ordered supervision and with the case open. It is labeled partial because it is one.

## (2) The route

Verified by walking the scenario graph from the start node (see the verification note at the end). Key decision points, in order — node title, winning choice, and what it changes:

1. **Paper the Petition Didn't Quote** — *Sign the written request for the agency file today, and keep a stamped copy for your folder.* Cash −10. Sets **recordsRequested** — the hinge the whole win hangs on. Under 55 Pa. Code § 3130.44(d), the record "shall be released upon request." Without this signature on Day 1, the nurse's original note never reaches you before the hearing.
2. **Thanksgiving, With a Copy in the Folder** — *Photograph the timeline and send it to Beaumont before you sleep.* Sets **timelineWritten**. Costless, and it fixes the October Thursday in writing while the memory is still plain.
3. **The Neighbor Who Saw the Car** — *Drive across the county on his break: ask him in person, give him the date, explain what testifying means, then call Beaumont within the hour.* Cash −12. Sets **witnessReady**. This is the difference between a witness and a voicemail: asked properly and early enough, Mr. Danquah can be arranged through counsel; assumed, he cannot.
4. **Saturday's Mail** — *Open the agency's packet first, and find the school nurse's original note.* This choice is flag-gated on **recordsRequested**. Hidden item: the nurse's original note, released on written request — three lines, with "possibly the evening work trip, per Jade" still in them, where the petition has "left unsupervised overnight."
5. **The Summary That Quotes the Petition** — *Have Beaumont challenge the summary's factual error under Rule 1340(E) and (F) — knowing, and saying, that the argument is untested.* Cash −15. Sets **summaryChallenged**. The scored summary had quoted the petition's version of the night as if it were fact; the challenge puts the factual error on paper before the hearing. (Whether Rule 1340 reaches a scored assessment summary has **not** been tested in a published opinion — the scenario flags this every time, and the route does not depend on the challenge succeeding.)
6. **Adjudication Morning** — *Pay the parking, take the folder from Beaumont, and go in early.* Cash −8. No flag; just arrival, with the plan intact: object at the offer, corroborate briefly, stop.
7. **The Moment the Report Is Offered** — *Beaumont rises: "Objection. The report should not carry adjudication without its maker here to be examined."* Sets **objectionMade**; hidden item: the objection, made and ruled on, in the transcript. This is the single most important choice in the scenario — the nurse is not on the witness list, not in the building, and the objection must be spoken **before** the report is relied on, not regretted after.
8. **Sustained, in Part** — *Beaumont offers the nurse's original note through counsel, and asks the court to read all three lines.* This choice is flag-gated on **recordsRequested**. Hidden item: the note, offered as an exhibit. The judge has already ruled the overnight allegation cannot rest on the unexamined report (and that the agency may call the nurse at a continued session or proceed on what it has — the agency proceeds). Now the author's own words replace her summary.
9. **Call the Neighbor** — *Beaumont calls Mr. Danquah, who stands, takes the oath, and gives his name to the reporter.* This choice is flag-gated on **witnessReady**. Hidden item: the neighbor's testimony — the father's car in the drive by 9:40 p.m., Jade fed and supervised at his table and collected that evening.
10. **Emmett Takes the Stand** — *Testify briefly — the timeline, Danquah's table, the car by 9:40, Jade carried home — and then stop.* Sets **testifiedBriefly**. Corroboration, not re-argument: Emmett never had to prove innocence, and a short, dated account is what lets the closing stay a map of the agency's missing proof.
11. **Closing: What Was Proven, and What Wasn't** — *Ask the court to dismiss the petition: the overnight allegation is unproven, and the nurse's own note explains the school week.* This choice is flag-gated on **recordsRequested** + **witnessReady** — both hinges, set back on Days 1 and 5, are what make the full ask available. Hidden item: the court's order, in which the overnight allegation is not among the findings. It leads to **Dismissed — A Report Is Not a Witness**, and you finish the route with $105 of the $150 starting cash.

Supporting route choices that cost nothing: arriving at the objection with the petition annotated and the timeline written (Days 0–3), and telling Beaumont exactly what Danquah saw — and nothing beyond it — at **Asked Properly**.

## (3) Why this wins — the law as it is supposed to work

Only principles from the scenario's verified set are stated here:

- **The two stages are different rooms.** At adjudication, the court may find a child dependent only "from clear and convincing evidence" — 42 Pa.C.S. § 6341(c). The burden is the agency's; the parent does not have to prove innocence or fitness; a fact not proven is a fact the court cannot use. If dependency is not proven, the petition is dismissed and the child discharged — § 6341(a).
- **Written reports get their wide welcome at disposition, not adjudication.** At disposition, "all evidence helpful," including written reports, may be received even if it would not be competent at adjudication — § 6341(d)(1). And even there, the parties may examine and controvert written reports and cross-examine the people who made them — § 6341(d)(2). The winning argument is exactly that map, made on the record at the moment the report was offered through a caseworker who did not write it: a report whose maker never appears cannot carry adjudication by itself.
- **The file was obtainable all along.** The agency record "shall be released upon request" — 55 Pa. Code § 3130.44(d) — and the rule is not to be read to protect agency employees' privacy as a basis for withholding — § 3130.44(f). Step 1 is that right, exercised in writing, in time. It turns the objection from principle into paper: the note's own "possibly" and "per Jade," and its one-line explanation of the school week.
- **The scored summary is challengeable — as an argument, not a settled right.** Pa.R.J.C.P. 1340(E) allows evidence and argument to rebut a provision, and Rule 1340(F) allows factual errors to be challenged. Whether Rule 1340 reaches a scored assessment summary has **not** been tested in a published opinion. The route makes the challenge and labels it untested in the same breath; the win itself rests on the adjudication objection and the exhibits, not on the flag.
- **The partial ending is the same law with a thinner record.** Where a narrower finding is proven on evidence the court can weigh, disposition may order the child to remain with the parent subject to conditions and supervision — § 6351(a)(1). Before any disposition that removes a child, the court must enter findings on the record about contrary welfare and reasonable efforts to prevent removal — § 6351(b), which the loss ending's debrief reflects.

## (4) The traps

1. **Cooperation-silence at "The Moment the Report Is Offered."** Letting the report pass "to seem cooperative" is the scenario's fatal trap, and it produces **"Adjudicated on Paper."** Admitted without objection, the report does the work testimony never did: the petition's overnight sentence enters the findings nearly word for word, placement continues, and the debrief's verdict is that the objection existed the whole time — unspoken, in the hallway version of the day.
2. **Skipping the record request at "Paper the Petition Didn't Quote."** The objection survives, but it arrives as principle without paper: no original note to offer, nothing to show the judge the "possibly" the petition dropped. The win's closing choice is flag-gated shut, and the route ends at **"Dependent on Less Than the Agency Asked"** (partial) — the overnight allegation struck, a narrower supervision finding standing, Jade home under § 6351(a)(1) supervision.
3. **Assuming the neighbor at "The Neighbor Who Saw the Car."** A voicemail — warm, vague, missing the date and everything testifying involves — leaves Mr. Danquah on a double shift with his phone in a locker, and counsel unable to arrange a witness he never knew about. No **witnessReady** means the hallway chair is empty on Monday, the corroboration never happens, and the win gate stays shut: the route ends at the partial ending, **"Dependent on Less Than the Agency Asked."**
4. **Re-arguing the whole petition at "Emmett Takes the Stand."** Testifying at length is sincere and costly in the same breath: under cross-examination it supplies the narrower facts — coverage assumed rather than confirmed, a dead phone, a school call that slides between days — that a judge can rest a smaller finding on once the large allegation is struck. This trap also routes to the partial ending, **"Dependent on Less Than the Agency Asked."**

## (5) What no strategy controls

Whether the agency takes the judge up on the continued session and calls Mrs. Castellano — her live testimony might have clarified her note in Emmett's favor, or hardened against him, and no preparation controls which woman walks into that courtroom. The judge's credibility calls, on Danquah's concessions as much as on anyone's confidence. Danquah's employer, his shift, his car starting on a cold Saturday. The route above controls only what was ever Emmett's: a request signed on Day 1, a neighbor asked properly on Day 5, an objection spoken in the right ten seconds, and testimony that stopped when it was finished. Outcomes in this system turn on workers, judges, resources, and luck as much as on any parent's choices — the strategy's whole claim is that when the uncontrollable arrived, the record was ready for it.
